New Court Rules January 1, 2012
New
rules went into affect January 1, 2012 on tthe certification of process
servers in Texas and also on what needs to be on a Return of Service.
IWe urge all our clients to become aware of these new rules.

Ensure that the process server you use is certified by the Texas Supreme Court or else the service is invalid and there could be civil and criminal sanctions. Texas maintains a list of state certified process servers here: http://www.txcourts.gov/psrb/server_list.asp
The state is periodically purging the list in 2012 of people that no longer have valid certifications according to the recent rule updates.

Harris County Service

Fee $70.00
- First delivery attempted within 48 hours.
- Includes 3 delivery attempts.
- No extra fee for the notarization of the return.
- No extra fee for mileage.
Rush Fee (requested first attempt upon document receipt): + $25.00
Extra Documents/Parties Served (at same time & location): $40.00 each
Wait Time Fee (with telephonic approval): $70.00 per hour
All
documents are picked up and returned to the client's Houston area
office.
If desired, Pickup/Delivery to the Harris County Courts
is available at $20.00 per trip (extra documents at same time are no
charge). If delivered to the courts, a scanned copy of court time
stamped return is available at no charge upon request.
Adjacent Counties (Brazoria, Fort Bend, Galveston, Waller, Montgomery, Liberty & Chambers)
Same
fee structure as Harris County plus round trip mileage from Downtown
Houston or the Galleria area (whichever is closest).
Process Service Outside the Houston Area (Outside Harris & Adjacent Counties) - Regular Service

Hand Delivery of Sealed Documents (Signature Required)

An affidavit of delivery will be provided upon request at no
additional cost.
